Alignment of WAD and EAA
The objective of the Web Accessibility Directive (WAD) is to ensure that public sector bodies of member states of the EU are digitally accessible and for explaining how the requirements of WAD can be met, is included Annex A (more precisely, tables A.1 and A.2) in EN 301 549.
According to the recital 46 of EAA should the accessibility requirements of EAA be aligned to the requirements of WAD:
Directive (EU) 2016/2102 defines accessibility requirements for websites and mobile applications of public sector bodies and other related aspects, in particular requirements relating to the compliance of the relevant websites and mobile applications. However, that Directive contains a specific list of exceptions. Similar exceptions are relevant for this Directive. Some activities that take place via websites and mobile applications of public sector bodies, such as passenger transport services or e-commerce services, which fall within the scope of this Directive, should in addition comply with the applicable accessibility requirements of this Directive in order to ensure that the online sale of products and services is accessible for persons with disabilities irrespective whether the seller is a public or private economic operator. The accessibility requirements of this Directive should be aligned to the requirements of Directive (EU) 2016/2102, despite differences, for example, in monitoring, reporting and enforcement.
Thus I suggest to update the current tables instead of creating separate tables for explaining how the requirements of EAA can be met except if it is absolutely necessary (i.e. a requirement of the European Commission) or it decreases usability of the current tables.
Although it seems to me that WAD and EAA aren’t aligned at one particular issue. The WAD leaves “live time-based media” out from the scope of accessibility requirements (WAD art 1) and that is reflected in the EN 301 549 as well (Note 4 at the pg 89 of EN 301 549). Unfortunately, I don’t see similar clause in EAA. It's noteworthy as WAD and EAA are aligned in other similar issues (i.e. office file formats and pre-recorded time-based media published before certain date). I wrote to the Commission and asked clarification on 21 March.
